This presentation takes a sample case that can be seen in most any area of law that involves ESI today, for both Federal and State matters. The speakers will show you the sample RFP (Request for Production) that has been sent by opposing counsel, then discuss the different terms, definitions,… Show more and implications of this request. After discussing the RFP for this specific set of collected data, we’ll go over three sample workflows that are commonly used by sophisticated law firms for early analysis and culling in preparation for review. The three workflows will be constructed based off these variables:
1. Number of custodians; 2. Percentage of relevant documents; 3. Knowledge of data prior to review; and 4. The need for ECA (early case assessment) utilization (other workflow criteria will apply).
Ultimately, this presentation is meant to show that given the slightest change in the law firms' knowledge of the data being collected and/or the knowledge of expected percentage relevance for production, both factors can affect what workflow should be used for an efficient discovery and review process.
About the Speakers:
Alex Marjanovic is a Regional Director for DTI, a national provider of electronic discovery services, with responsibility for San Diego, Orange County (CA) and Phoenix (AZ). He has had extensive experience with electronic and paper-based discovery and related litigation production/discovery matters over the past 10 years. Alex and his team of nine Litigation Consultants help in-house and outside counsel streamline their document reviews and productions by guiding them through efficient and cost effective electronic discovery Technologies and Methodologies.
In the course of his career, Alex has served in a variety of sales and consulting roles, assisting clients with the evaluation and implementation of paper and electronic discovery strategies and workflows, and presenting CLE programs on a variety of litigation readiness and document review topics. His CLE presentations have included “Early Strategies for Successful Document Management”, “Paper Discovery in an Electronic World”, “I Think I Just Received Electronic Discovery: What Now?” and “Collection of ESI & the Ethical Swamp”. These CLE programs have been presented to over 40 Law Firms and Legal Organizations, with over 500 attendees in the past three years alone.
Alex is a graduate of the University of California at San Diego, from which he received a B.A. degree in Political Science, and has attended and participated in numerous advanced educational programs in electronic discovery, information governance and other course related topics.
Greg Mahoney currently serves as a DTI E-Discovery Consultant for multiple territories including Orange County/San Diego, CA, Phoenix, AZ and Las Vegas, NV. Prior to DTI, Greg held positions with both the U.S. Government and AM Law 100 Firms.
Greg was introduced to the e-discovery world during his time with the Massachusetts’ Department of Revenue Litigation Bureau. While working with this municipality, Greg utilized tools such as Concordance and CaseMap to assist with the case team’s discovery needs.
As a litigation technology analyst at Mintz Levin, Greg gained additional experience with litigation support tools such as Introspect, LiveNote and Law 5.0. Daily usage of these tools expanded his skill set and exposed him to the granular issues that need to be considered throughout the lifecycle of a case. In addition to supervising internal processes, Greg served as the liaison between case teams and service providers on large scale e-discovery efforts.
After Mintz Levin, Greg joined Gibson Dunn and Crutcher where he advised the firm’s clients and internal case teams on best practices throughout the EDRM including but not limited to, forensic collections, data processing, hosting, and document review. After utilizing Relativity for years, Greg achieved the RCA credential and performed the first internal TAR matter using Equivio.
Overall, his experience within the government and law firm setting allows Greg to view e-discovery issues and challenges through his client’s perspective and tailor workflows for their particular needs. He is a University of Dallas graduate and received his BA in Political Science, magna cum laude.
